Tribunal representation

Tribunal proceedings can be very stressful for employers; current or ex-employees can make claims on a wide range of grounds including unfair dismissal, whistleblowing, TUPE or discrimination. If you receive a tribunal claim notification form (an ET1), there are also strict time limits for responses even if you are hoping to settle the claim and not get as far as the tribunal hearing itself. Despite attempts to make Tribunals more informal and streamlined, the reality is that the tribunal system is filled with jargon and governed by a special set of rules of procedure which can make the whole process bewildering.  

In addition, employers are faced with the whole range of Claimant tactics such as Subject Access Requests under the Data Protection Act (GDPR from 2018), Discrimination Questions/Responses or attempts to involve a regulator/adverse media coverage to increase the pressure on an employer to settle a claim.

Costs

Many employer clients worry about uncertain legal costs in the Employment Tribunal system and that the costs versus the commercial benefit will get out of control.  Our lawyers are true specialists and do not do anything else other than employment tribunal work so this means that, following an initial  specialist case assessment, at Ashtons Legal we offer fixed fees to certain stages in the Tribunal so you, our client, are in control of what you are spending.
